JIVOME PRIVACY POLICY

Jivome’s Privacy Policy details what information we collect about our users and about your use of Jivome and its services. It will explain what choices our users have about how their personal information is used and about how Jivome protects that information.

This Privacy Policy applies to Websites owned and operated by Jivome (“Jivome Websites”), including Jivome.com and Jivome.org and/or any other sites and applications operated by Jivome or affiliated with Jivome, that are intended for use by non-professional consumers for non-commercial personal, family, and/or household purposes.

References to “Jivome” mean Jivome, Inc, and include any company that Jivome, Inc, operates or controls. Your use of Jivome’s Websites allows Jivome to share information among its subsidiaries or Websites that it owns or controls. However, information collected under this Privacy Policy is always protected under the terms of this Privacy Policy.

  1. THE INFORMATION JIVOME COLLECTS

If you choose to register or update an existing member profile with Jivome, you may be required to submit Personal Information. “Personal Information” means information that Jivome can use to identify or contact you. This includes your name, address, telephone number, email address, and/or social media accounts (such as but not limited to Facebook® and Twitter® handle), as well as other identifying information. Some of our interactive tools and services may request you to submit health information, which would also be considered Personal Information. You are responsible for ensuring the accuracy of the Personal Information you submit to Jivome. Inaccurate information will affect your experience when using the Jivome Websites and tools and Jivome’s ability to contact you as described in this Privacy Policy.

  1. Registration

Access to some Jivome services may be limited to users who have registered with Jivome and signed in to the Jivome Websites. Some of our tools, like the Symptom Educator, do not retain your Personal Information. Other tools, like Skin Type Profiler, store your Personal Information in accordance with this Privacy Policy.

Jivome will not make the Personal Information that you submit to the Jivome Websites available to third party retailers or advertisers. In addition, Jivome will not make any use of your Personal Information beyond the permitted uses in this Privacy Policy unless you provide additional consent in connection with the specific tool at the time you submit Personal Information in order to use the tool.

  1. Jivome Newsletters and Emails

At registration and at various times as you use the Jivome Websites, you may be given the option of providing us with Personal Information in order to receive recurring email newsletters that Jivome will produce from time to time. If you sign up for our email newsletters, you can choose to opt out of receiving additional newsletters from Jivome by following the directions included at the bottom of the newsletter.

  1. Emailing and Tweeting to Your Contacts

Jivome offers its users the chance to communicate with their contacts through a variety of social media tools directly through the Jivome Websites. If you use the Jivome Websites to email a contact, we will ask you for your name, your email address, and your contact’s email address. We will automatically send your contact a one-time email, inviting her or him to visit the site. That email will use your name and email address as the “from” email address. But Jivome does not use your contact’s email information for any other purpose. We will only use the information you provide to send the requested email to your contact.

If you use the Jivome Websites to tweet at a contact, we will ask you for your name, your Twitter® handle, and the Twitter® handle of your contact. We will automatically send your contact a one-time tweet inviting them to visit the site. That tweet will use your name and Twitter® handle as the “from” information. Jivome does not use your contact’s Twitter® information for any other purpose. We will only use the information you provide to send the requested tweet to your contact.

  1. Emails You Send to Jivome

This Privacy Policy does not apply to information, content, business information, ideas, concepts, inventions, or anything else that users send to Jivome by email. If you want to keep information private or proprietary, do not send them in an email to Jivome.

  1. NON-PERSONAL INFORMATION

Even if you do not register with or provide any Personal Information to Jivome, we may collect Non-Personal Information about your use of the Jivome Websites. “Non-Personal Information” means information that Jivome cannot use to identify or contact you. Jivome may also acquire Non-Personal Information about its users from external sources. While you may use some of the functionality of Jivome without registration, many of the specific tools and services on the Jivome Website require that you register with Jivome.

  1. Cookies and Web Beacons

Jivome collects Non-Personal Information about your use of the Jivome Websites and your use of other websites through the use of Cookies and Web Beacons. “Cookies” are small data files that are stored on the hard drive of the computer you use to view a web site. Every computer that accesses the Jivome Websites is assigned a different Cookie by Jivome. “Web Beacons” are graphic image files imbedded in a web page typically used to monitor activity on a web page and send back to its home server (which can belong to the host site, a network advertiser, or some other third party) information from your browser, such as the IP address, the URL of the page on which the Web Beacon is located, the type of browser that is accessing the site, and the ID number of any Cookies on your computer previously placed by that server.

Third parties under contract with Jivome may use Cookies or Web Beacons to collect Non-Personal Information about your usage of the Jivome Website, including which topics you have viewed. These third-party advertising service providers may use this information to help Jivome deliver advertising on the Jivome Websites based on your browsing activity on our sites. Jivome may further tailor the advertising on Jivome Websites based on additional Non-Personal Information to the extent known by Jivome or these third parties.

Most browser software can be set to reject Cookies. Most browsers offer instructions on how to reset the browser to reject Cookies in the “Help” section of the toolbar. If you reject our Cookies, certain of the functions and conveniences of the Jivome Websites may not work properly but you do not have to accept our Cookies in order to productively use the Jivome Websites.

  1. Non-Personal Information Collected by Third Parties Not Acting on Jivome’s Behalf

Advertisers on the Jivome Websites may use their own Cookies, Web Beacons, or other online tracking technologies in their advertisements on the Jivome Websites. Their advertisements may be displayed on the Jivome Websites or on other sites that you visit after you visit the Jivome Websites. Some advertisers use companies other than Jivome to serve their ads and to monitor users’ responses to ads. These ad servers may also collect Non-Personal Information through the use of Cookies or Web Beacons on the Jivome Websites.

Jivome does not control how third parties use Cookies or Web Beacons or how they manage the Non-Personal Information they gather through the use of these technologies on the Jivome Websites. However, our Advertising Policy prohibits advertisers and ad servers who collect Cookie or Web Beacon information through the Jivome Websites from collecting any Personal Information from the Jivome Websites without your consent. Our Advertising Policy also prohibits advertisers from linking any Non-Personal Information collected by them on the Jivome Websites to Personal Information they or others collect in other ways or from other sites except as may be described in connection with a particular program.

  1. USER CHOICES: UPDATING AND REMOVING PERSONAL INFORMATION

If you do not want your Personal Information used by Jivome as provided in this Privacy Policy, you should not register as a member or for any specific tool or application that collects Personal Information. You can review, update, and/or correct Personal Information you have previously submitted by going back to the specific tool or application, logging-in, and making the desired change. You can also update any Personal Information you have submitted by contacting us using the contact information listed below.

If you have registered and desire to delete any of your Personal Information you have provided to Jivome from our systems please contact us using the contact information listed below. Upon your request, Jivome will delete your Personal Information from our active databases and where feasible from our back-up media. You should be aware that it is not technologically possible to remove each and every record of the information you have provided to the Jivome Website from our servers.

III. HOW JIVOME USES YOUR INFORMATION

Information collected by Jivome about you is used by Jivome to:

Administer your account, provide you with access to particular tools and services, Send personalized emails or secure electronic messages pertaining to your health interests, including news, announcements, reminders, and opportunities from Jivome, respond to inquiries you send to us and to send you communications about the Jivome Websites or services, obtain your feedback about the Jivome Websites or our offerings, statistically analyze user behavior and activity including how frequently areas of the site are visited and how many emails are received and opened, provide you and people with similar demographic characteristics and interests with more relevant content or advertising both on the Jivome Websites or on other websites that you visit after you leave the Jivome Websites, and conduct research and measurement activities, including those described below.

  1. Research and Measurement Activities

Information that Jivome collects about you may be combined by Jivome with other information available to Jivome through third parties for research and measurement purposes, including measuring the effectiveness of content, advertising, or programs. This information from other sources may include age, gender, demographic, geographic, personal interests, product purchase activity, or other information. We may report aggregate information, which is not able to be identified back to an individual user of the Jivome Websites, to our current or prospective advertisers and other business partners.

We do not sell or share any Personal Information with any third parties, except that contractors performing services on our behalf may be provided access to Personal Information when performing these services. These contractors are required to agree not to use this information for any purpose other than performing services on our behalf.

  1. WITH WHOM DOES JIVOME SHARE YOUR INFORMATION?

Except as described in this Privacy Policy or as specifically agreed to by you, Jivome will not disclose any Personal Information it gathers from you through the Jivome Websites. Nor does Jivome provide access to users Personal Information or Non-Personal Information to either Contractors or Third-Party Websites. We may only release Personal Information to third parties (1) to comply with legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as in response to a physical threat to you or others, to protect property or defend or assert legal rights. In addition, we may disclose Personal Information as described below.

We may share Non-Personal Information that we have about you, including about your browsing activity on Jivome Websites and applications, with third party advertising service providers who may use this information, on our behalf, to help Jivome deliver advertising on the Jivome Websites as well as on other sites on the Internet. Non-Personal Information is information that is recorded about users so that it does not reflect or reference an individually identifiable user and is automatically collected when you access Jivome’s Website or tools through the use of a web browser or an application. Non-Personal Information may also include information that is publicly available that is shared between others and you.

In the event of a corporate change in control resulting from, for example, a sale to, or merger with, another entity, or in the event of a sale of assets or a bankruptcy, Jivome reserves the right to transfer your Personal Information to the new party in control or the party acquiring assets. In the event of such a change, your Personal Information will continue to be treated in accordance with this Privacy Policy unless any changes to the Privacy Policy are made in accordance with the section below that discusses “Changes to This Privacy Policy.”

  1. HOW DOES JIVOME SECURE AND RETAIN YOUR INFORMATION?

Jivome takes reasonable security measures to protect the security of your Personal Information. Despite Jivome’s efforts to protect your Personal Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

The security of your Personal Information is important to us. When you enter Personal Information (including personal health information in various tools on the Jivome Websites), we encrypt the transmission of that information or use SSL connections (Secure Socket Layer) technology.

Jivome will retain your Personal Information as long as your account is active or needed to provide you services. At any time you can remove your Personal Information or instruct us to remove it. However, you should be aware that it is not technologically possible to remove each and every record of the information you have provided to Jivome from our servers. Jivome tools that collect and store Personal Information allow you to review, update, and/or correct information you have submitted by going back to the specific tool, logging-in, and making the desired changes. We will also retain your Personal Information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

  1. CHILDREN

We are committed to protecting the privacy of children. The Jivome Websites are not designed or intended to attract children under the age of 13. The Jivome Websites do not collect Personal Information from any person we actually know is under the age of 13.

We recognize the need to provide further privacy protections with respect to personal information we may collect from children on our sites and applications. Some of the features on the Jivome Websites are age-gated so that they are not available for use by children, and we do not knowingly collect personal information from children in connection with those features. When we intend to collect personal information from children, we take additional steps to protect children’s privacy, including:

  • Notifying parents about our information practices with regard to children, including the types of personal information we may collect from children, the uses to which we may put that information, and whether and with whom we may share that information

Jivome reserves the right to change or modify this Privacy Policy or any of our tools or services at any time and any changes will be effective upon being posted unless we advise otherwise. If we make any material changes to this policy we will notify you by email (sent to the email address specified when you register) and/or by means of a notice on this website prior to the change becoming effective. We encourage you to periodically review this website for the latest information on our privacy practices. If you do not accept the terms of this Privacy Policy, we ask that you do not register with us and that you do not use the Jivome Websites.
